Non permitted deck

Hey everyone, so just looking for some advice. Live in Ontario, Canada. Deck that is attached to house is non-permitted. Stairs going to upper level deck are sloping so will have to deal with that. When we bought the house, our lawyer got the deck covered under the former owners title insurance. So if we want to redo the deck, do I have to have the municipality tell me to tear it down? Or can I just reach out to our lawyer for title insurance?
