Sewage backup from city tree - can I fight city hall?

I’m experiencing ongoing sewage backup being caused by a city tree digging it’s roots into my pipes. Does anyone have any experience with this? Is the city liable because it’s their tree damaging my sewer pipes or am I out of luck?

Edit: it’s definitely a city tree, and it’s definitely on city property, it’s located on the portion of the sidewalk nearest the roadway.
