Shed in Fenced in Yard, HOA sent letter for removal

Post Body

I installed a Suncast shed, HOA says it needs to be removed. It is showing above the fence slightly mostly the roof of the shed (not visible from front yard, just visible over back concrete wall that separates from road). Per the HOA covenants the only mention of anything close to a shed is “temporary structures,” and it states that it must be approved by ARC. Per the ARC guidelines there is nothing mentioning “sheds”. After slight contact with HOA management company they say “sheds are not allowed in community and ARC will say the same, but cant site a source where it says that in any covenants.

My question is do I have any way to fight this? I mean it does not have any guidelines for sheds anywhere other than ARC has to approve. Do you think neighbor signatures will help sway ARC meeting that happens next month.

Update: for those interested its HOA 1/me 0…when the ARC got ahold of it they labeled it as a “storage building” (which I overlooked and is prohibited via covenant’s). I just got rid of it instead of pre-suing either getting coventnts changed or a further appeal ;(
