Nope. If they're not super heroes, then neither is Batman. Simple math: Thor kills if necessary, which is one of the qualities that make him worthy to wield Mjölnir. He's the King of Asgard, and must be ready for war, and all that it entails. Nobody views him as anything less than a superhero. Bottom line: some supervillains (who are dangerous to the population on a planetary level), should be put down permanently. Hal deals with planetary threats all the time. He can't keep coming back to put the "bad guy" in alien prison. He's part of the corp, created by the "Guardians of the Galaxy", and even they would understand. Bad writing made them follow the blue boy scout's rule for many decades, but killing a villain that endangers nor values sentient life, especially when protecting yourself, doesn't make you a bad person.
