I need some advice on a plumbing quote. Is there a plumber out there who can verify something for me?

The community in which I live has a small clubhouse. We need a water heater installed if we are to rent it to people for parties etc. The quote we received was for a 40 gallon wh. I asked if we could get a smaller WH, maybe 20 gallons and was told it's a code thing. It goes by the number of bathrooms. The problem is that the two bathrooms are powder rooms. There are no tubs or showers. Just toilet and a sink. There's also a small kitchen. No dishwasher.
Can someone verify this for me???
