Damaged tree delivered, return or will it be okay?

I've just had a Liquidambar tree delivered and the main trunk was snapped about 1m from the top. I'm pretty annoyed! There are some branches just below the break and perhaps they'll grow up just fine and it will still attain its full height? I don't particularly want the bother of returning it but don't want a stunted tree either. Advice welcome!
