So to recap:
Like everyone I had TONS of issues with 1.0 and 1.11 software including regen, adas, key fob, and no start issues.
I sent my official letter to fisker for repair before lemon law but I traded in my vehicle for a substantial loss.
Fisker did not reply to my official paperwork regarding repair which to me was surprising. This allowed me to officially file my complaint to NCDS as outlined in the warranty documents.
“Since I no longer own my vehicle I am ineligible for arbitration”
So now what I am looking for is - fisker made a lot of promises regarding features that they never put forth. Some of which were stated in the preorder contract that they were withholding to get us our vehicles sooner BUT they would be on the website with timelines (some of which only state 2024).
Now would it not be false advertising to list features of a vehicle that the vehicle does not have, nor a planned delivery time? Ie Valet mode, remote climate control, vehicle preconditioning, memory features
These are all stated as features on the ocean one/extreme with no dates for expectations. Meaning I would expect them on the vehicle.
Would anyone know the best way to handle this?
