I’ll make this short with all relevant details. I was the victim of domestic violence at the hands of the mother of my children. I evicted her from my home (during the heart of the pandemic, it was like that.). Mother is unstable. Publicly identifies as a witch. After the eviction was granted, she made false allegations of harassment. I was charged with telecommunication harassment, an M1, arrested in front of my home while I was playing with my three young kids, who all witnessed this. They granted a TPO with a stipulation that I had to forfeit my firearms. I’ve complied with everything. Since there was literally no evidence, the charges were dropped just last week, including the TPO. The judge will not approve the release of my firearms. No reason given. Well, technically, the first reason given is because it’s a stipulation of the TPO. My attorney told him the TPO was vacated. Judge still said no. Then, what are the odds that two nights ago, my home was broken into WHILE I WAS INSIDE. Luckily my children were not there but they broke my garage door which is attached to my home and entered at least the kitchen. I know this because I have a security camera over my garage, the garage door was left open, the door to the kitchen was left open, my kitchen smelled of cigarettes, and the security footage showed them pushing one of my go carts down the driveway with an air compressor, power washer, and tool box.

The judge still won’t release my firearms despite there being no court order for them to have them and I am legally allowed to possess. My attorney is even baffled. I don’t know what to do. The angry part of me wants to petition outside the courthouse. The more nefarious part of me wants to offer anybody and everybody help with building their own “ghost gun” with the aid of my 3d printer. The sane part of me is at a loss tho because I’m a single father with three young children and do not want to get into any legal trouble. I would really like advice from this community. If I’m wrong, I’m wrong and I will walk away. But as it sits now, I feel like my rights are being violated.

Edit: the state is Ohio and I will add that while I have old, as in 15 year old criminal charges (underage drinking) I have never committed a violent offense or made threats of any kind. The initial charges were brought upon, in my opinion, in retaliation to the eviction of my childrens mother when she committed domestic violence against me.

Edit:: hey everyone I did not expect this post to take off. I’ve been reading every response and I’ve made calls to groups many of you have recommended. I absolutely am fighting this to the end. I have my kids this weekend and we’re camping as an end of summer celebration so I will reply and post updates on Monday when we return. I appreciate all the support. Like seriously, I appreciate it so much. I felt hopeless. My attorney spoke directly to the judge and told him no, he will not return my firearms and if I continue to pester the court, he will make sure they are destroyed. I love my home and I worked damn hard to buy it, but I’m moving out of this city. I’m hoping a family member will move in so my kids can remain in the district. Thank you all again. Updates to come.
