Where is the Line Regarding Outsourcing Licensed Positions Legally?

An old employers I used to work for got fined for doing licensed activities (I don't think trades, but more back office stuff), but there are rumors my current employer might shift some licensed back office positions overseas. How legal is that and further is it more of a rounding error in terms of fines in their mind, as it seems like they are asking for trouble in my opinion.
