This happened to my friend last night he was at a skateboarding event all day and over the course of the day he literally had 2 beers and probably smoked a joint he was also skating in this event. When it was over he was exhausted so when he got in his car he decided to take a nap he was woken up by a cop my buddy didn’t have the keys in the ignition they were on his lap and the cop took him to jail . My buddy asked the cop repeatedly to do a blow test to prove he was under the limit the cop refused to give him a test and he was charged with dui he just got out of jail eariler this evening. He has a clean record he will get a lawyer do you think he can easily beat this? The cop had a body cam so clearly it will show him asking to take the breath test.
