My son is 6 and I'm trying to move out to Texas. I'm the unmarried mother and no paternity test has been taken. There's also currently no court orders in place. The father's name is on the birth certificate. If I move before he can file for custody will the court make our son come back? Will the custody battle take place in Texas or California if I move before he can file for custody? Please do not judge me. He is not fit to raise our child and has an abusive history but nothing on his record.
