I am needing some advice. I’m currently going through a divorce that involves my husband who committed acts of domestic violence and child cruelty and was recently found guilty. We have a daughter together who is in my care and currently getting supervised visits with her dad but he’s also got pending felonies and is probably going to prison.
Early on in our relationship I assisted him with getting full physical custody and legal custody of his daughter from a previous relationship he only had temporary custody at the time and never had followed through with full custody because bio mom wasn’t following the parenting plan that was in place and was leaving him to care for the daughter. She was 6months old when she was put into his care by the state. She stayed in my care and his until the time of the domestic violence and child cruelty incident when she was once again put in the care of the state and eventually under her paternal grandmothers care while her dad was in jail.
My question is now that he’s been convicted of child cruelty charges and the daughter is not being properly protected from a child abuser(he’s in the home she’s in) can I file for emergency custody of her even with no relation?
The state wanted to keep siblings together but it was ultimately his decision to place her with his mom and I have reason to believe she’s not getting the care or protection she needs.
Any advice would be appreciated. Georgia case.
