Hi folks,

Here are the details:

Mother - has custody, is in poor health, and on disability. She is listing emergency guardians in case she can no longer care for child.

Father - no contact order with child.

Father would like to also list his choice for child's emergency guardian.

This child is my partners family. If he/we are listed and we're at anytime given guardianship, I would likely need to become the primary caretaker. The kiddo is likely pretty behind in development and will need extra support/appointments/care. This would push me to reduce my hours at work or completely quit.

  1. As the kiddo is not related to me and my partner and I are not married, would I qualify for pfml? Would this be considered 'foster'?

  2. If his mother passed would he be eligible for survivorship benefits?

  3. Can they/do they require visitation with extended family? We have some concerns with our required level of interaction with the other side of the family.
