How are people able to publish 'unofficial' works on material? Example: The Unofficial Harry Potter Cookbook. at what point does 'Unofficial' cross the line?

As the title states, when is a line being crossed from 'Unofficial' to infringement. Does simply stating that something is unofficial absolve people from suits?
