Employer: Hey, I have a question. Employee: Is it related to work? Employer: (chuckle) yeah. Employee: I'm not clocked in yet. Employer: (chuckle) Well, it's a quick question (proceeds to ask question).
Where I work, hourly employees have to clock in at their computer. They can't clock in until their official start time. That's the official line. Unofficially, if employee doesn't respond to work related question, he or she could suffer negative consequences. Those that do with while not clocked in are seen as go-getters and enjoy the benefits. Is this legal?
