Post Body

Me and my wife were traveling to Arkansas last week for a music festival. Ended up getting stopped 11 hours into our drive from wisconsin, was tired as fuck and it was dark, a cop was following me and I had accidentally driven into the left turn lane instead of the straight lane at a curved intersection because it followed the center line and appeared to be the proper lane at the time, and corrected myself after getting through the intersection.

The cop pulled us over stating I swerved into the othe lane back there. Cop asks me for license and registration, then asks me to step out of the far for "a talk", I ask "may I ask why?", all he kept saying was we need to talk. Since I'm anxiety ridden and was anxious as hell I just got out of the car. The officer got into his squad car and asked permission to search the vehicle, I asked what the probable cause was, He asks again "Do you give me consent to search the vehicle, if you don't I'm going to have a dog sniff it and if he hits I will search."

I don't remeber exactly if I consented or not, I don't really recall. I remember telling him I don't seem to have much of a choice.

He states his probable cause was "We are attending a festival that is known to have drugs, so he has probable cause enough and just needs to make sure we'renot csrrying any substances in tbe vehicle."

Anyway to make it to the point, after the dog "hit" or signed (which based on how the cop says the dog signaled, it didn't) I was placed in cuffs/detained and they searched the vehicle and separated my wife to another squad car. I basically ended up telling the officers what was in the vehicle considering how nervous and anxious I was, And I understand that is stupid and I should have kept my mouth shut.

They found About 3.5g of shrooms, probably around 5g of weed, 7g wax, around 4g of ketamine, 1g of 2cb (which they think is mdma apparently), 10 tabs of lsd, our scale, tray, baggies, caps, and fent test trips.

They charged us with 5 felony possesion with purpose to deliver charges, including a posession of fentanyl with purpose to deliver. We did NOT have fent in that car, and if it was in one of the substances we did NOT know it was in there and would absolutely toss it if it did. The officer also kept hounding/asking my wife if there was any fent in the car. He found the test strips, and told my wife "I thought you said you didn't have fent?, What are the fent test strips for then?" We DID NOT have fent in that vehicle, just test strips....

What is everyone's experience/knowledge on this situation? Are We fucked? Or since it's first offense will a lawyer be able to drop it down to just posession charges, drop fent and just get probation? Court dat is in November, and I'm really scared/nervous as to what the outcome will be. Especially it being Arkansas.

TLDR: Was stopped in Arkansas for traffic violation, and police searched the vehicle. I can't remember If I gave consent. They found About 3.5g of shrooms, probably around 5g of weed, 7g wax, around 4g of ketamine, 1g of 2cb (which they think is mdma apparently), 10 tabs of lsd, our scale, tray, baggies, caps, and fent test trips. It was all just our personal stash/amounts and was not intended to distribute. This is a first offense, but I'm scared we may face jail/prison time. Is there a possibility we would just get probation and fines since it is a first offense?
