Stbx & I have agreed on 50/50 custody. How are the number of days determined? Is it by where the child spends the night? I am working out a temporary schedule with stbx before a permanent one can be decided in mediation.

She seems to think she should get a couple extra nights with our child because I get to spend more "quality time" with our child (this is due to me having a day off during the week a couple times a month were I keep him home instead of day care).

I don't think this is how the court or mediator would divide the time.

I know there must be a determining factor on what defines a "day" in these custody situations. I am only seeking an equal amount of days on the calendar, not hours physically spent together. What she chooses to do with her time when our child is with her is up to her, same for me.
