Disclaimer: I think the evidence against rick is strong. I could care less if gull, rossi or baldwin come back. But here is my opinion.
For all the gull haters. I believe she was not certain she had the right to dq R&B. She didn’t want to worry about whether or not it would be appealed. Rossi actually makes a comment to this effect regarding her checking with other judges re disqualification on 10/19. So she played her hand and told them what she was inclined to do if the hearing went forward, hoping they would just withdraw. This would take the appeal issue off the table as they would withdraw on their own. They can’t appeal their own decision.
This is essentially a poker move by gull. Its not wrong nor inappropriate. But does indicate she had doubts that she could remove them.
R&B were so worried about looking bad in the media they didn’t think in that moment as to how they could use the media to their advantage. They had no idea what investigators actually knew about the extent of westermans leaks and did not want to be caught off guard. They folded. They didn’t call gulls bluff and withdrew. They definitely regret playing it this way and not having the hearing go forward. But I think this shortsighted decision was, at the time, partially motivated by the fact that at least Baldwin knew mitch was leaking details online to sway public opinion (allegedly)…
Now, we are all waiting for the supreme court’s opinion on unprecedented motions that are the result of bad decisions from all parties. It will make horrible precedent if they side with R&B, not so much if they side with gull.
I will apologize to anyone who requests if I am wrong and they side with R&B. Admit im wrong over and over. But if they side with gull just don’t say the Indiana Supreme Court are corrupt odenites.
