Seeing if anyone has any idea on this because I feel portfolio recovery is just blowing smoke up my butt. I had a personal situation and fell behind on some credit cards for a while. They got send to collections and I've been paying small amounts on all of them, but one fell through the cracks with portfolio (have 2 with them).
So 2 and a half years ago I get served with papers that they are going to sue. I didn't do anything and I've never heard anything back about it until a month ago. Portfolio has been calling me, my phone auto says it's spam and blocks it unless I'm on the phone. So I answer and they are looking for me to make payments again on this collection. I explained that I've never received anything on the court case or anything. He said he can see it and gives me info, I can not find it on any pa court site, he gives me the attorney's name and I can find all kinds of cases from that time with him suing people but not me. Guy on the phone has me set up a portal login with them and someone sends me a PDF with court documents. Thing is, all of these documents only have the attorneys name on them, one has a stamp from the courts for a file date and not one of them has a judge's signature/information/etc on any of them.
I'm not a lawyer but did work on one while I was in college. Shouldn't there be a signature other than the attorney suing on the judgement document? Shouldn't there be a stamp by the courts and the judge's name or something printed below his signature? Also if they got judgement, why would it take 2.5 years to contact me about it?
Sorry, just looking to see if anyone thinks this is valid or bs. With the other account I have with them, they've been jerks, threaded to sue because they want me to pay more a month. They drop it after their "deadline" evwrytime and I even asked them about this account once and they said all they saw that I had with them was the other account like a year ago. Portfolio is a scummy place 😩
