Ability to move states
Our child was living with the other parent until a few years ago in NY. We shared legal custody but they had physical custody.
I won physical custody. Our child was ordered to move to the state of VA with me. Court also ordered we still share legal custody.
Last few years I was living with a different partner and that relationship is over. I can't afford this area alone and found other states affordable with better or comparable schools.
The other parent doesn't want the child to leave this state despite the other parent living in NY.
The order stated our child to move to VA when I gained custody. It also ordered both of us to communicate where we reside at all times if we move.
Court orders for visits and locations. Other parent has not had communication nor visits with our child since I got custody. Even when our child visiting NY(grandparents and other family) the other parent doesn't have visits with the child(their choice)
I am aware if I left to NC the order would have to be followed if the other parent wanted to excersise her visits. I won't have a problem making that happen.
There is also option for other parent if they stopped by VA they could have additional visits with our child. I could still adhere to this as I have family in this state still and they are willing to host.
Do I need their agreement to leave this state? Looking at NC, WV, or MD?
