Maybe Vandal Savage/Ras are his lawyers. They know every precedent ever put to paper.
Also I feel like other inmates would eventually try to whack him. He's charismatic but there's a point where enough people who you led to their deaths are gonna have relatives who're angry waiting for you once you get into the slammer.
The problem lies not in the rule but the nature of comics in general and Batman villains in particular. These things cannot be treated as a vacuum. Due to the nature of comics you have a 10-20 year rolling timeframe in which the villains become perpetually more omnicidal and Batman still treats them as comic relief rogues who happened to strangle an old lady or two while other heroes have killed enemies with a vastly lower body count.
