So like I don’t know how much help I can honestly get from this but I was riding my bike and the light just turned yellow when this lady full on gasses it no brakes cuts me off making her left turn. We hit and basically my bike got totaled she has a tiny dent. Anyways she gave me and the cop her insurance and the cop didn’t find out she didn’t have valid insurance so basically he talked to both of us together and mentioned “I need to fix my things” I asked what ? Stupidily and he says right infront of her something about my license , keep in mind I’m suspended due to getting pulled over riding my bike with no motorbike endorsement. Anyways , I was in the process of getting it fixed when this happened but due to her not having insurance we have to go to small claims court as I only have liability. Basically my question is do you guys think my case would get thrown out due to me being suspended if she were to use that argument. Cuase theoretically I had all the proper precautions to be a road worthy vehicle while she Did not, this happening in a at fault Cali state I believe she will need to be held at fault for the failure to yield and get ruled in my favor.
