Legality of DME's continuing to charge customers for Phillips CPAP Machines

It is illegal in the US to sell a product that has been recalled until the recall has been satisfied and the product repaired. This restriction applies to both new and used equipment. All those folks on Craigslist trying to sell their used Dream Stations are actually violating federal law.

Is it legal for DME's to continue to charge "rent" on a device that has been recalled and according to the manufacture should not be used? Should they not be required to provide a legal replacement or stop charging rent?
