Got bored and decided to fix College Footballs NIL/Transfer Portal disaster.

NIL and the Transfer Portal were poorly thought out and hastily implemented solutions to the real problem of the historic lack of compensation and fairness to the college athlete.
These two issues are currently feeding off each other creating a disruptive ripple effect through college football and if they are not addressed very quickly then I believe we will see a sharp decline in the overall quality of football being played, a rapid decline in the fan base and interest in the sport and also a net negative effect on future college athletes.
The Ideas and contingencies outlined in this memo are designed to make sure college athletes are compensated and treated fairly while also making sure college football retains the positive qualities of amateur athletics that universities and fan bases have embraced.
1. RECRUITMENT
The recruitment process and the rules and regulations already in place should try to be kept in place but a review process to make sure there is no conflict with suggested changes should take place.

  1. PLAYER CONTRACTS
    Any player receiving a scholarship and or NIL money will sign a standardized contract with the University that will be enforceable by law. The Player Contract will be designed to ensure that a student-athlete has a commitment to play for the University and that the University has a fiduciary obligation to the student-athlete in terms of quality education, compensation, and ongoing medical treatment.
    I. The Player Contract will be for a minimum term of Three (3) Years.
    II. The Contract will stipulate a Standardized amount of monthly income for all scholarship players. (amount to be argued over but no less than $3,500 per month for the full year, not just during football season)
    III. The Contract will detail allowable reasons for contract termination by either the University or the Athlete.

a. An Athlete's contract is not performance-based. As long as they remain a student in good standing at the university and participate in all football-related activities that medical staff deems them physically and mentally fit to engage in, then the University may not terminate the Player's Contract. (details will be long, detailed, and litigious.)
b. An athlete may terminate the current Player Contract and be eligible to sign a new Player Contract with a different University for the following reasons.
1. The Head Football Coach, which recruited them is either fired or resigns. (They may not sign a new Player Contract at the former coach's new school.)
2. Breach of contract by the University
c. The University may terminate a player's contract if the Athlete refuses to play or participate if cleared to do so by a competent medical staff. For being convicted of a crime. By not meeting the minimum academic standard required of any student of the University.
d. The Student-Athlete and The University may mutually choose to terminate the Player Contract.
e. The University, The Coaches, or The Staff may not receive any funds, benefits, or services that would entice them to terminate A Player Contract or create conditions in which a Student-Athlete was forced, threatened, or coerced into terminating their Player Contract or to be in breach of contract.
3. NIL FUNDS
A Student Athlete may receive NIL payments and endorsements but all payments and funds from an NIL agreement must be placed in an interest-bearing escrow account till the end of the Athlete's Third (3) Year of their Player Contract.
If a Student-Athlete is found to be in Breach of Contract then those NIL funds will be forfeited and divided evenly between all the Contract Student-Athletes in the same class to be distributed at the end of their Third (3) Year.
If a Student-Athlete decides to legally terminate their current Player Contract for cause then they will also forfeit any NIL funds but they will be eligible to sign a new Player Contract with a different University and accept new NIL funds. (IF a player terminated their contract for cause at the end of their second season and signed a new contract for the following season they would still be eligible to receive any new NIL funds at the end of the next year.)

  1. THERE IS NO MORE TRANSFER PORTAL
    This is only a brief outline of what would be a very detailed rule change and contract BUT I think even in its first draft form this idea of doing away with the Transfer Portal, creating a Player Contract that holds both sides accountable, and withholding NIL money till the end of a players third year solves most of the issues that I feel certain will destroy college football within a decade.
