Hello, I'm getting ready to file and I've been literally in a financial shit mess since last October.
I'm a contractor, and I had to open up a new LLC due to a frivolous lawsuit I'm involved in. I was working as a sub but I've been named in this lawsuit, the major contract I have requests me to have a separate LLC for the work I do for them because of this lawsuit.
I acquired covid in October of 2021, and I've had nothing but medical issues since. From October of 2021 until now I have lost almost 25 weeks of work due to injury time.
My income has dropped significantly since, but my expenses haven't.
I suspect I'll go chapter 7. I have literally no assets at this point. I have a 1999 pickup with 185,000 miles on it, a 2007 Honda pilot with 190,000 miles and a 2003 Volkswagen with 270,000 miles.
I have a handful of tools, maybe about $3,000 in total.
I have $60,000 in credit card debt. I made the mistake of starting my business on personal credit cards. But unpaid invoices from COVID mandates, and then the slew of work related injuries stemming from having covid have just hurt.
I've paid all of my credit cards on time, a few are closed with 0% interest payment plans, one is in collections, but that is being paid as well.
My monthly credit card minimums are about $1,700 a month.
What got me to this point is I was out of work for about 8 weeks on a knee injury. I also was docked income from the client on a damaged door. These both caused me to default on all of my credit card payments in August. September has only become worse. I've had issues with Venmo, the landlord wanted his back rent paid in cash. So I am currently sitting with two checking accounts in the negative, and one with $200 in it. I get paid this coming Wednesday. So I'm only a few days away from getting paid. I average about $2,500 every two weeks on 1099 income.
The work is steady, but I can't keep paying these bills, and it's financially got me in a bind.
I'm wondering if it is possible to file personal bankruptcy, go chapter 7 and keep my new business open?
I've tried going back out on the CDL route, but having been out of the driver's seat for 3 years I'm finding myself having a hard time getting a job. So I'm still doing contractor work.
Any advice or insight works be appreciated.
