I've been working for my job for about 3 years now and was diagnosed as autistic at the beginning of this year. I have not told my employers as they aren't progressive and definitely would not understand. I work pretty closely with clients and in sales which can make me quite nervous. Recently, I asked my employer if there was a possibility of going to a 4 day work week (currently work 8-5, 5 days a week) as those hours have been very exhausting where I can't really doing anything in my free time due to exhaustion and would like to improve my life by just having an extra day off. The building industry is slowing down quite a lot at the moment so thought this would work well (as they have been worried sales are down). I also asked and presented a way for me to be less sales based, which wasn't an issue at all for them as it actually works out quite well for the team, so that they can focus more on sales.
However, they have just come back to me and said that 4 days will not work for the job, which I understand as they have to do what is best for the business. However, they also presented me with a letter stating that in the past 6-12 months, they've observed my behavior as very anxious, not participating in team discussions and not being chatty with my co-workers and that they are very worried about my mental health and want me to see a professional to provide a certificate stating I am fit to work in order to keep working. I was honestly so confused and asked if this has all come from the fact that I asked for 4 days and they said yes as well as me being stressed out (which is true, workload is high but everyone is stressed at this time). In regards to not participating in team discussions, I don't speak unless I have something of importance to add and have always been like this. And I am very friendly with all my colleagues and get along with all of them but yes I don't spend hours chit chatting like some of them do as I have work to get done, and never have been like this.
This letter has honestly offended me. I have not done anything other than being stressed at times and opening up to them about the 4 days/less sales based. Its not like I am having a breakdown or not turning up to work or anything. I'm considering resigning because of this and since I cannot keep doing these hours. Just wanted to hear if anyone had thoughts and if I'm being unreasonable???
In the US, I am pretty sure a job can't ask for your personal health information just so you can continue working there. They can ask for documentation regarding a disability if they are trying to give you an accommodation, but continuing at your job is not an accommodation. You asked. They said no. That should be the end of it.
Lawyers are expensive. I can see why you might be hesitant to contact one. However, it might be a good idea in this case. They could be working up to firing you.
In the meantime, you may want to start looking for another job. It sucks, but it is better to be over prepared than to be out of work unexpectedly.
