Iām a corrections officer with a somewhat major US cityās corrections department. Unlike most US county jails, which are typically run by county sheriff, we are a separate dept and are fully sworn peace officers with full arrest power and jurisdiction throughout our county. (I share this to try and give any info that maybe relevant to an expert). Recently our HIP division (Home incarceration program āhouse arrestā) was ordered by a judge to fit multiple individuals with gps monitoring devices and to monitor them with our system as we do with inmates placed on the program. The issue is none of these individuals have been arrested, or accused of any crime. The order was placed due to them testing positive for CORVID-19. They were told if they violated the house arrest order they would be arrested for contempt of court. Our union says we do not support this as we are the county jail and should only deal with persons accused of crimes, and last I checked itās not illegal to get sick. This is the first time in my career in law enforcement that Iām very uneasy with a situation. This, to me, screams a violation. of ones rights. Granted if someone was placed on HIP by a judge and violated after seeing the judge post-arrest they would go to jail if they violated the order, but those people had been at somepoint cited, or arrested and arraigned. These individuals hadnāt.
That being said, is making the agency who handles criminal incarceration the standard for those situations?
Iām not directly involved in the situation, was just lookin g for answers due to the whole thing not smelling right with me. But I will be discussing all answers with my union President
