Question about medical surgery gone wrong

If a surgery gone wrong happened 12 yrs ago by a doctor that had Parkinson's.
And now the very same surgery has been performed recently, but there was some complications because of the surgery that happened 12 yrs ago.
Also, because of the first surgery there seems to be some PTSD.
Is there anything we can do or is it too late to pursue anything?
