Malpractice at vet?

Hi everyone. Today I took my bunny lily in to see if she was pregnant and to get spayed if she was not. The vet palpitated her and did not feel any babies so he proceeded to cut her open to start the spaying procedure only to find out she was pregnant. Is this malpractice considering the vet did not find out about her pregnancy and had not used an ultrasound after palpitating her did not tell him she was pregnant before cutting her open to start the process of spaying her? Should I be worried?
