[MCU Avengers] What is up with Rhodes? [Spoilers]

Rhodes was working for the U.S. Military as War Machine and then later as the Iron Patriot.
Now he's back as War Machine and helping out (and later becoming part of) The Avengers. Considering the Militaries dislike of SHIELD and the lack of paint on his armor I can assume he's left the Military and is either working for SHIELD or as is a free agent.
What's the deal? Did he have a falling out with the Military or was he discharged?
