Hi, I am needing help on what steps to take next as the plaintiff in civil law suit. So in summary, I sued a landlord for an unreturned security deposit. We went through mediation and the defendent did not hold up to his end of the agreement so I filed for default judgement. I was granted default judgment and was able to get a garnishment on his bank. When the sheriff's went to serve the bank, the bank's lawfirm responded that they did not have an account for someone with that name and had us pay them $100. I then sent the bank's lawyers the proof of deposit which has the defendents bank account number on it. The bank then replied to me and the court that they have recovered the funds (double the amount of the default judgement). So now, this is where I am stuck. How do I go about collecting this money from the bank? Do I essentially start the garnishment process over with the court filing another motion for writ of garnishment? I am in Florida.
I hope that's enough detail, and I apologize in advance for my lack of proper use of legal terms. I don't have a legal background, but I made it this far in the process on my own! I am hoping to figure out this final piece here and get this over with!
