This might be a little goofy, but inquiring minds need an answer. Recently my girlfriend and I were watching My Strange Addiction on Hulu, and one episode came on where the subject was “addicted” to pony play, i.e. dressing up like and behaving like a horse. One of her favorite activities to indulge in during this was to pull a cart or carriage that had another person riding in it as the carriage driver.
The question I have for you today is, if the person who was riding in this human-horse drawn carriage happened to be over the legal blood alcohol limit, could they be charged with a DUI? Assuming that all the requirements for a horse drawn carriage on a public road were met, of course. Also, how would you handle this situation?
