Hi all, I would like some insight on how to handle an unusual “retention offer” from my institution. I am in a humanities field and in my fourth year in a TT position at a public R1. I have two prestigious external fellowships this year and was just given a “preemptive retention offer” (based I guess on concerns that these fellowships will make me competitive for a better job). The offer is a small raise ca. $7000 that barely brings me above some recent hires in my department. Fine, whatever, but more concerning is a clause that I will not seek employment until 2029 (!). This seems preposterous and I understand from colleagues that 3 years, not 5, is the typical retention offer clause. I received the letter without warning without being given a chance to negotiate, so I have asked for a meeting.

My questions are: -Is this clause not to seek other employment at all legally binding? Can I ask they lower or remove it? Does anyone have experience with breaking a promise like this? No punishments are listed. -What leeway might I have to ask for things I would have in a normal retention offer that is a counter offer? Research funds, higher salary, etc.

I am ok but not super happy with my job and I do anticipate going on the market selectively in the coming years, not least because of serious equity concerns with my current salary. I would like to improve my situation with this offer but not prevent myself from jumping ship. Thanks for any advice.
