In December 2022 our furnace went out unexpectedly during one of the coldest days of the year. We found an HVAC to come out and inspect the unit. They informed us the unit was dead and that we needed to get it replaced. The individual sold us a new furnace and AC unit as a package deal.
Fortunately they were able to come out the following day and install both units. The AC we were told was not going to be “finished” installing until April or May of 2023, which was no big deal.
We ran the furnace as normal through the winter and as summer approached we called to have them finish the installation of the AC unit. Everything has been great up until December 2023.
At this time the furnace stopped working again like it did the previous year. We called them several times and eventually scheduled a repair. They did a no call no show for that appointment. I was fed up with them at this point and found a new company to deal with.
They came out in January 2024 and discovered the system was completely installed incorrectly. Not only was it incorrect the individual said whoever installed it was either an i***t or they purposely installed it incorrectly to warrant more visits out. He mentioned all the pressure gauges and the fine tuning was completed in a way that would ruin a furnace in about 5-8 years.
Now with the heat of the summer, we have had 3 instances of the AC unit no longer working. When I called the company that repaired the furnace (new company) they said it’s strange we are out/low of refrigerant after 1 year. They will be here Wednesday.
At this point we have spent $12k plus on the furnace/ac as well as the first visit with the new company which was roughly $1k in repairs as well as an upcoming appointment that may be the same.
Would there be any way for us to file for damages or negligence? I did want to mention the original company that worked/sold us the unit have been bought out and are under new management.
