Genuinely not sure if this would be a contracts or property law inquiry.
My partner owns his condo but never looked at his HOA documents. Thereās been an issue of a neighboring unit with a roach infestation thatās caused the occasional roach to come into our unit. I started reading through the paperwork to see if thereās anything the HOA can do to intervene. In the HOA declaration there is a clause that states each owner shall keep the interior of their unit āā¦including, without limitation, interior walls, windows, glass, ceilings, floorsā¦ in a clean, sanitary and attractive conditionā¦ā would a roach infestation be in breach of this clause and the HOA can take action against them?
Additionally, in the state of Colorado, all board meeting minutes are to be kept indefinitely; however, for the past 6 months there were no āapprovedā minutes which seems ridiculous to me. I want to reach out to the HOA to ask about their minutes approval process, but can anyone provide insight for why they havenāt been approving minutes?
