Long story but I’ll try to condense as much as possible. I am the executor of a trust for a 60s male with high functioning Down syndrome. A friend of a friend of his asked for a family to move in his home while they were waiting for their apartment to be ready. Supposed to be two weeks and here we are a year and a half later. I didn’t find it about them until it was way too late and they already had squatters rights. They pay no money and have utterly destroyed his home to the point it is not even livable. There are two adult women and 5 minor children.
Friday I went over with a real estate investor who wants to purchase the home. This will give us the money to move him to an apartment and take care of his bills. I was physically assaulted resulting in a concussion, rib contusions and a large hematoma to my abdomen as they were kicking me in the head and body while I was on the ground. This took place in front of the minor children, the gentleman that I take care of (home owner) and the real estate investor.
Police came and no arrests were made. The investors attorney said we need the women’s last name to file for eviction. The police have yet to even file a report on the assault. We do not have the money to move him into another place until we sell the house.
So my questions are:
Do we have to have a last name to file for emergency eviction?
Is there any other way to get their information other than the police report?
I’ve contacted CPS, APS and the local police as well as my police in my city as they are now making threats against my life. I’d love to file for a PPO but again I don’t know their last name which I’m told I have to have.
