Forgive my non-lawyer musings/questions.
Homelessness is only getting worse not better.
I'm trying to do whatever I can to think outside the box.
I like the example of health care. In BC and all of Canada health care is the responsibility of government. Everyone can go to the hospital when in need.
Homeless people are left out in the cold literally or crammed into shelters.
Could anything below be used to help the situation?
In international law:
The ICESCR
Article 11.
Specifically The right to adequate housing.
Article 28.
Are of note.
In Canadian law:
Section 12 of the Charter. I can't think of much more cruel then being homeless.
Civil negligence
Duty of care
I recognize I'm throwing spaghetti against the wall and seeing what sticks.
I'm curious if there is at least some merit to my thoughts?
