Hello lawyers, I am having a dispute with my HOA in regards to the parking of my boat. The HOA documents say behind a fence, which it is from the front and not in view from any part of the frontage of the home or property. However, I have a corner lot and there is no fence on my side yard so it is in view from the street and sidewalk. There are no homes across the street from the side just unimproved land.
Florida statue 720.3045 says that I cannot be restricted in parking it as long as it is not visible from the parcels frontage or an adjacent parcel.
This is the legal definition I found for adjacent:
Adjacent means either immediately contiguous to or abutting a neighboring property, lot or walkway, and excludes property, lots, or walkways across the street from, or diagonally opposite across an intersection from the subject property, lot, or walkway.
I believe based off the statute and the definition of adjacent it would be fine as is. Correct me if I'm wrong.
