So I'm going to try and keep this as short as possible because I'm on my phone and I could write a book about all the bs, I'll try to stay relevant but want to make sure I don't leave anything that could be important out.
I've worked a construction job for the past 19 years. I'm 34 now and started when I quit school around age 16 but I worked there before then and worked for the owner for many years before hand doing other jobs. I'm very good at my job and have run my own crew the last year doing some quite big jobs the biggest being 4 60x220 warehouse type buildings. I made 7k off that. was told he forgot to include the forklift rental in the price so that's all the profit for my half.
I've been told since I started that when my father retires the company is mine. around 2 years ago he started getting very serious about retiring. I've been making poverty wages since I started getting 1 raise after 8 years to 15 an hour from 12.50 an hour. I was never able to get food stamps or abby assistance because he didn't want his employees to be seen as needy and refused to fill out the paperwork or you would be fired. I put up with it because it would pay off when I was in charge.
when he started getting serious I asked him if he was going to screw me over, sell and give my sister the money or anything. he said absolutely not. I told him that I'm going to start my family then and get a truck to transport my crew and equipment around. I got my wife of 10 years pregnant and have 20 month old twins a boy and girl. when the time came for me to take over he said no one is building goo find another job, you should've went into the union, no one wants to work and a whole host of other excuses until I finally !convinced him that I'll start my own company just show me how to bid jobs, give me 1 forklift and tell me what I need to do to be a legal legit business. he agreed I got my LLC used all my savings in the meantime (it was months before I got him to agree and ive made nothing before hand so I barely had 6k).
so with diapers and car payments and I had to live with my mother in law I'm broke. I do another job building a mini storage and never get to meet the client never see the bid and he brings one guy with him that he's paying. after the job he tells me that he wants me to get a notarized contract saying that I was responsible for all the workmans comp for that job. I know it's a long shot but wth I'll try and happily pay it I mean look at all the bs I've taken so far and I'm so close. cannot find a notary that will do it because it's illegal. he's been withholding my payment until i can get the paper. i tell him I've called every notary i could find no one will do it. he knows I couldn't afford workmans comp yet or any insurance btw but i figure I'll pay the fines whatever atleast I'll ne able to provide for my family and not waste the last 19 years of hardship. anyway he blows up at me says take all the profit (10k supposedly, quite a round number oddly) and never speak to him again. never bought my kids Christmas presents either year btw.
Do I have any recourse? I have several people that will testify I was promised the company. people from different times throughout yhr years. people that know he convinced me not to join the union and work for him on that promise. I've got no job, no resume, he won't validate my work history, what can I do? I feel like such a failure, I'm not going to be able to feed my children, I'm so depressed and feel like there's nothing I can do. my sister's have turned on me and took his side, big surprise he's always given them everything they wanted and they want his inheritance. better for them that im out of the will. I've got no family to lean on and he's got millions but he will absolutely let us starve in the cold.
