I have been working full-time nonstop for the same company since January 2020. As Fachkrafte (high-skilled), I am elligible to apply for permanent residency (Niederlassungserlaubnis) starting this month.
Things aren't going well at my company and they might cease operations at some point this year. As a result, there is a good chance that the Auslanderbehorde won't issue me an Aufenthaltstitel. Some of my work colleagues have gone to renew their Aufenthaltstitel in recent weeks and were essentially told: 'The status of operation or closure of your company is undetermined yet so we cannot confirm it by giving you a one-year Aufenthaltstitel".
I was told that I can request a Fiktionsbescheinigung instead which is what I plan to do. I don't know, however, if my PR application can be turned down on account of not having an Aufenthaltstitel. I have a lawyer so I will check this with him as well but I wanted to have your thoughts (and information) first.
