I think the light is green now. Nothing really to fight anymore. It is not a protected area for a certain bat so construction can begin at any time. The case was mostly about eminent domain being used for a private business (that ostensibly benefits the public). Pretty much if you have deep enough pockets, anything can happen! Also, courts never second guess officials and referendum in a town if it is "legal," even if they disagree. The fact that Pyramid bought a neighborhood, let it rot, likely violated town rules to maintain property in some minimum way is moot now. There is no remedy anyway anymore, and if the town was OK with it, they are too.
