Got sold a "new" 3ds XL for 400 dollars at a game shop. It was an new old model. The store wont take a return. I'm so furious

I asked the guy behind the counter if they had a new 3ds xl. I had never seen the box before so I didn't know that the new model had NEW written on it. The guy sold me a model in an unsealed box for 430 dollars with tax. I got home and realized my mistake, but when I went back the store refused to refund me. I saved for so long just to get this damn system. I'm on the verge of tears. I'm furious. I dont know what to do. I gave them a shitty yelp review but that's about all I can think to do.
