CAN CTS BE AN INTERNAL ARRANGEMENT FOR PAYMENT BALANCE?

Hello po! Just wanna ask. I have a buyer for my house for 2.5M and lot and I know na kapag may DOAS na, expected na paid in full na siya.

Kaso si buyer ay may 2M cash lang. Payag din syang sagot nya lahat ng transfer fees, payments, and taxes like CGT, DST, Transfer tax etc basta lahat. Umabot yun ng 280K including magbabayad sa mag-aasikaso.

Ngayon may balance pa siyang 500k. Initially, nagbayad sya ng downpayment developer ng 350k pero nag-withdraw sya ng purchase dahil yung unit ko na lang bibilhin nya. Same price lang pero yung sakin RFO na. Na-turnover last Nov 2023.

Gusto nya na ipaasikaso yung transfer and part nun ay DOAS. Okay lang ba mag-DOAS na pero yung CTS will be an internal arrangement for us? Okay lang naman sakin na may balance siyang 500k payable within one year.

Ang question ko lang:

  1. Legally binding ba siya kung sakaling di na sya makabayad? May habol pa kaya ako knowing na na-transfer na ang title sa kanya?

  2. Okay lang din ba na mag-demand ng 10% interest of the balance sa CTS if in case hindi nya mabayaran ang 500k after one year?

  3. If hindi, ano po kayang pinaka-ok na gawin. Inask ko na sya na mag-loan na lang siya sa bank ng 500k or kahit PDCs kaso sabi niya mahirap daw. Plus, waiting sya sa refund na 350k from Amaia. Kaya nya na daw yung 150k baka mas maaga pa daw. But I want it in writing kasi mahirap humawak sa salita lang. Ngayon, okay siya pero pano pag nagka-emergency siya?
