My husband was collecting the mail at our leasing office today. It was rainy and he slipped and fell on the painted concrete staircase leading from the mail room. It was a nasty fall and after many hours in the ER the diagnosis is a compression fracture of his T7 which will require further evaluation from a spinal specialist and possible surgery.
Is there any way this could be considered negligence on the part of the apartment complex? Hubby's theory is that if the stairway wasn't painted the water wouldn't be pooling there when it rains and the surface wouldn't be as much of a slip risk. We're trying to determine if we need to find legal representation or if we just need to accept a dose of really bad luck.
