Hi all,

Recently moved out of a home we rented for 5 years, 4 of which were month to month.

For 3 of those years, we had a friend live with us not on lease. We had verbal permission, and landlord acknowledged he lived there a few times in email. Lease is a template that says requires written permission, or there is a $30 per day fee. We frequently asked for a new lease, but homeowner drug his feet.

Fast forward to now. We moved out 1.5 months ago, and have received nothing about deposit. We had place professionally cleaned, and there was no move in inspection. Homeowner ghosting us. If I sue him in small claims, does he have a case to countersue for the extra roommate (3 years at $30 a day is a lot...)? Or do these kinds of fees have to be claimed at the time of incidience?
