My mother had a mishap with a pedestrian today in a parking lot. She was backing out of a space, heard yelling and stopped. She had hit an elderly woman, or rather some apparatus that the woman was using. Not sure if it was a cart or walker.
The woman seemed fine and she hadn't taken a tumble or fallen. She said she wasn't hurt and wanted to be on her way, but she was with a man who said he was her guardian, as she was senile. He insisted on a police report, which was fine. Then he insisted on medical attention. The woman again said she was fine, but he was firm. So an ambulance was called.
My mom is still hysterical several hours later. She didn't get any names from the small crowd that had gathered. Hopefully they will be on the police report. They told my mom she didn't actually hit this woman.
She was driving my aunt's car, and my aunt is critically ill. Mom is visiting and trying to take care of her. She is terrified of telling my aunt as aunt is rather a mean and hostile person.
So if insurance needs to get involved, would it be my aunt's auto insurance or my mom's? She is in IL now where the accident happened and where my aunt has insurance, but her own auto insurance is in OH and I believe she is covered when driving another's vehicle with permission. Should she contact insurance company now or wait for a claim?
The woman's guardian kept yelling at my mom about negligence and now she is terrified she's about to be sued. He may have been an ass or he may just have been genuinely concerned about an elderly woman's health. I can't tell because my mom is crying and not so coherent!

Edit: She mostly feels bad about a near miss with a little old lady, not a potential lawsuit. She feels like a horrible person and now she's thinking she's going to lose her home as punishment.
