Hi All,
I had a contractor (well who I thought was a contractor, later found out he has no license, and is just a handyman) remodel a bathroom.
I have decided to withhold final payment ($1,660) until the work is done correctly. There is a leak in the wall, and several tiling and grout issues. I am getting second and third opinions from contractors tomorrow on how it needs to be repaired. After I do that, I will be giving the original handyman a list of what he needs to do (and how to do it, I.E, removing grout and regrouting, instead of just putting a light coat over) for him to get the full final payment.
However, he has threatened a mechanics lien. He has also said if I bring in another contractor to review his work he won't come back. I have told him I want to be fair but am very disappointed in his work and need a 2nd and 3rd opinion to make sure it is done right. I want to give him the chance to fix his work, but it will likely involve expense on his end as I am not buying the new grout and new tile if needed. He is going to have to pay for that.
My question is is his threat of a mechanics lien valid? I know he can file it but can I challenge it in court and get it taken away?
