Have a friend, have a rule of thumb to not represent friends in criminal defense, that went through a tragic event. Long story short gave CPR to someone who unfortunately passed away, admittedly he had 2 beers beforehand, at a traffic accident he was not involved with which has been proven by video footage. He was charged with a DUI. To be clear I am not the friend.
From my research and prior precedent, https://law.justia.com/cases/new-mexico/court-of-appeals/2005/f580-1c753-1cf92.html, adrenaline has clear effects on alcohol absorption and BAC.
Does anyone have experience with a case such as this? The deceased party could have had excess alcohol which led to the event or as stated above adrenaline caused heavy breathing. This is for my own personal knowledge, in my 7 years of practice never have encountered this before.
