It's come to the attention of the government of Mount Augusta that the number and size of bunkers being built within the borders of Mount Augusta by private individuals is on the rise. At the same time, we are also seeing an increase in the amount of violent conflict between foreign parties in our city. In order to avert further unchecked escalation of paramilitary activity within Mount Augusta, this bill is proposed to modify the law as necessary to place regulations on paramilitary infrastructure within our borders.

The main actions of this bill are to:

  1. Define paramilitary infrastructure according to function, with determination made by Judges.
  2. Impose a requirement that paramilitary infrastructure in Mount Augusta can only be owned by Augustan citizens.
  3. Impose a monthly stamina fee on citizens who are dual citizens or who have not taken the Oath of Allegiance to legally own such property.
  4. Permit government seizure of such property after a warning of 48 hours for non-compliance with the either of the above.

Modification to the Bill of Rights

In order for this legislation to have any effect, a modification is necessary to the bill of rights, article V (addition in bold):

V. Neither the State nor its representatives shall under any circumstance seize the property of Augustan residents with except through means available to all private individuals, unless the property is paramilitary infrastructure and is also in violation of the law.

Modifications to Article II, Property

The definition of property should be expanded to define paramilitary infrastructure as a special category of property. Article II part A, section iii currently reads as follows, pay special attention to the last category, "means to undermine Mt. Augusta's sovereignty and/or territorial integrity". We expand on this theme.

iii. Property may not be modified, moved, or destroyed without the consent of the property owner unless such action is the minimum required to bring such property within legal bounds or is being utilized in the act of a crime or as a way to escape justice or as a means to undermine Mt. Augusta’s sovereignty and/or territorial integrity.

This bill adds:

iv. Property which can be reasonably inferred by a current Judge to be a bunker, vault, trench, trap, secure tunnel, or skybridge, and which is also reasonably inferred to have a military function, is considered paramilitary infrastructure and may be regulated.

This bill also adds Article II part C as follows:

C. Paramilitary Infrastructure Regulations

i. Paramilitary infrastructure is considered illegal unless owned by a citizen of Mount Augusta.

ii. Paramilitary infrastructure that is legally owned by a citizen who is also a citizen of another nation or who has not taken the Oath of Allegiance is subject to a monthly stamina fee.

iii. The stamina fee for infrastructure dues is to be collected no more often than once every 4 weeks, at a rate determined monthly by the Mayor and announced in a post in /r/mtaugusta tagged [INFRASTRUCTURE DUES] at least 3 days in advance of the due date. Citizens who hold no foreign citizenships and who have taken the Oath of Allegiance are not subject to this fee.

a. Each person paying such dues will do so for each such structure they own. Determination of what comprises separate structures is at the reasonable discretion of current Judges. No person may be charged more for a single structure than any other person.

b. A legal owner of such a property may opt to instead receive a buyout payment from the government of 5 times the proposed dues, in exchange for transferring permanent ownership and control of the structure (including namelayer groups) to the government.

c. Alternatively, if a property owner does not wish to pay dues, they may opt to completely remove the structure to the satisfaction of a Judge.

d. Dues shall be held collectively by the government and used for the purpose of future buyouts per part (b) above or to fuel legally-held pearls inside Mount Augusta. Mishandling of the dues by government officials may be prosecuted as 200.01 theft.

iv. Should paramilitary infrastructure be discovered to be in non-compliance with any part of the above, including due to invalid ownership or nonpayment of dues, the discovery should be announced by a government official in /r/mtaugusta with the tag [ILLEGAL INFRASTRUCTURE] including the coordinates of the structure and a notice of the following:

a. The owner of the property has 48 hours to bring the property into compliance with the law either by transferring ownership to a citizen, paying outstanding dues, or removing it to the satisfaction of a Judge.

b. If transferring property to a citizen, if that citizen is subject to infrastructure dues, they must be paid retroactively for the current month at the last announced rate.

c. Ownership cannot be transferred to avoid dues. If the old owner was subject to dues and the new owner is not, the new owner is responsible for the old owner's unpaid dues.

d. Failure to comply with any of these requirements will result in the property being seized by the government.

v. Paramilitary Infrastructure that is used by its legal owner to facilitate the crimes of griefing, theft, murder or treason according to the Mount Augusta Criminal Code, and for which a conviction has been obtained through the Augustan legal system, may also be seized by the government at the discretion of the Mayor.

vi. Property seized in this way or handed over to the government for a buyout will have ownership dispensed at the discretion of the Mayor with the approval of at least one Judge. The government may contract private entities to assist in securing the property and demolition if necessary.
