Continuity issue regarding Hailey's age

So, last season, Phil and Claire took Hailey out for drinks in the episode where they're trying to pressure her into picking a career path. Yet, this season, she turns 21.
Is the drinking age different in California, or is this just an oversight? Because she even says last season that Jay loves drinking with her because she's funny when she's buzzed.
